Most
employers view the complexities of employment
law as an impediment to what they want to achieve
in business. Although employment law is a vital
part of our armoury when advising, our approach
is to work with clients to establish exactly
what they are looking for and find the solution
which fits them best. Generally the solution
which fits the client will require a commercial
approach and careful direction from us but it
also tends to be simple and direct.
When drawing up employment contracts and policies
we also aim for simplicity and directness because
it is important for both an employer and its
employees to understand the basis of their relationship
as most disputes result from a failure to confront
an issue before it becomes a problem. It is
for this reason that clients can outsource many
of their HR issues, including training, to us
where they do not have a dedicated HR function.
The right action at the right time invariably
saves costs for employers in the long term.
When acting for individuals we adopt the same
approach. Individuals can be focussed on what
they believe their rights to be rather than
working out what they really want. When contacting
employers on their behalf or advising individuals
how to do so in person, our aim is to encourage
an employer to confront any problems and resolve
them, and where necessary, pay appropriate compensation.
This allows us to effectively negotiate exit
packages and compromise agreements.
